Can the police force me to take a blood test?
Florida DUI laws allow law enforcement to conduct a forcible blood draw under limited circumstances. While some states are allowing police to take blood from drivers who refuse to submit to chemical testing, Florida has no such law. In cases where there is an allegation of serious bodily injury, the law enforcement officer can have a doctor, nurse, or other qualified emergency medical personnel take blood against the consent of the driver. This is known as a legal blood draw. In some situations a DUI prosecutor can attempt to obtain medical records from the treatment provider. These are known a medical blood draws.
